MEMORANDUM OF AGREEMENT
BETWEEN
INDEPENDENT CONTRACTORS
AND
BRICKLAYERS AND ALLIED CRAFTWORKERS LOCAL UNION NO. 1 STONESETTERS
The following changes to the Collective Bargaining Agreement between Independent Contractors (“Employer”) and BAC Local Union No. 1, New York (“Local 1” or “Union”) Stonesetters effective July 1, 2021 through April 30, 2026 have been agreed upon and will commence on May 1, 2026 and extend for a period of two (2) years. All other terms and conditions of the prior agreement shall remain in full force and effect.
The following changes were agreed upon:
1. Duration of Agreement: The Employer and the Union agree to execute a two (2) year Collective Bargaining Agreement (“Agreement”) which shall be effective as of May 1, 2026 and shall expire on June 30, 2028.
2. The terms of the Agreement shall be the same as the terms of the Independent Contractor’s Agreement with the Union for Stonesetters that by its terms shall expire on April 30, 2026, subject to the following modifications:
A. Economic Increase
i. Effective May 1, 2026, there shall be an increase of $3.25;
ii. Effective July 1, 2027, there shall be an increase of $3.25.
B. Scope, Recognition, Term, Work Days
i. The parties agree to remove the reference in Article 6, Paragraph 1 to “time and one
quarter” such that the first hour of overtime is paid at time and one-half.
ii. The parties further agree to revise Article 6 in its totality to reflect any future
language changes that are agreed upon between the Union and the Contracting
Stonesetters Association, Inc. (“CSA”).
C. Apprenticeship System
i. Article 16 is modified to remove and modify the following language:
1. Remove “40% 0 – 800 hours”
2. Modify “50% – 0 –800 hours”
3. Modify “60% – 801-1600 hours”
4. Modify “70% – 1601 – 2400 hours”
5. Modify “80% – 2401 – 3200 hours”
6. Modify “90% – 3201 – 4000 hours”

ii. Article 16, Paragraph 2, is replaced with the following sentence: “Employer shall maintain a ratio of two (2) Journeymen to one (1) Apprentice.”
