MEMORANDUM OF UNDERSTANDING

 

Local 46 Metallic Lathers Union and Reinforcing Ironworkers

 

And

 

The Cement League

 

This MEMORANDUM OF UNDERSTANDING is made by and between Local

 

46 Metallic Lathers Union and Reinforcing Ironworkers (hereinafter “Local 46” or the

 

“Union”) and The Cement League (the “Association” or “Employer”).

 

All terms and conditions of the Collective Bargaining Agreement, and recent

 

Memoranda of Understanding, remain in full force and effect unless modified by this

 

Memorandum of Understanding. It is mutually agreed that the collective bargaining

 

agreement between the Union and the Association shall be amended as follows:

 

1. TERM:

 

Article XIII Duration of Agreement: Section (1) shall be amended to read as

 

follows: This Agreement is to be effective from July 1, 2024, through June 30,

 

2028. Written notice of a desire to terminate or modify this Agreement must be

 

given to the other party by certified mail /return receipt requested, one hundred

 

twenty (120) days prior to June 30, 2028, or this Agreement shall renew for four

 

(4) year periods thereafter.

 

2. JOURNEYMAN WAGE INCREASES:

All wage increases are subject to allocation by the Local 46 membership.

 

Additionally, in the event this Agreement is fully executed after the

 

effective date of an increase, the increase shall be retroactive to the

 

effective date referenced above.

3. APPRENTICE WAGE RATES Current Apprentice Rates will remain the

 

same from July 1, 2024 through June 30, 2025. Effective July 1, 2025, the

 

Rates shall be as follows:

4. The parties reiterate their understanding that Cement League Employers

 

historically have not performed public works, infrastructure work, or other

 

work subject to New York City, New York State or United States Department

 

of Labor prevailing wage requirements. Some Cement League employers are

 

already engaged in this work, and the Cement League employers have

 

expressed their interest in continuing to bid on and perform such work in the

 

future. The parties agree that the appropriate wage and supplemental benefit

 

rates to be paid to workers performing work on such public works,

 

infrastructure projects, or other work subject to City, State or Federal

 

prevailing wage requirements shall be the wage and benefit rates established

 

in the Collective Bargaining Agreement between Local #46 Metallic Lathers

 

Union and Reinforcing Iron Workers New York and Vicinity and the General

 

Contractors Association of New York Inc.

 

5. The parties agree that for private work performed pursuant to a Project Labor

 

Agreement (“PLA”), Local 46 has the right to specify in Schedule A of each PLA

 

if the work shall be at Cement League terms, conditions, and rates, or at

 

Prevailing Wage terms, conditions, and rates.

 

6. The Union and the Association agree, as soon as may be practicable, to rewrite

 

the outdated, expiring CBA.

 

7. Shift Work Premium – Article IV, Section 4 shall be amended as follows:

 

The second sentence currently states:

 

The first seven (7) hours or eight (8)hours, depending on the length

 

of shift designated by contractor on the project, shall be at the
