MEMORANDUM OF UNDERSTANDING

SHEET METAL & AIR CONDITIONING CONTRACTORS ASSOCIATION OF NEW
YORK CITY, INC. and SMACNA OF LONG ISLAND, INC.
And
INTERNATIONAL ASSOCIATION OF SHEET METAL, AIR, RAIL AND
TRANSPORTATION WORKERS LOCAL UNION NO. 28
This Memorandum of Understanding ³028´ is made and entered into by and between SHEET
METAL & AIR CONDITIONING CONTRACTORS ASSOCIATION OF NEW YORK CITY,
INC., and SMACNA OF LONG ISLAND, INC., ³SMACNA´ or the ³$VVRFLDWLRQs´), and
International Association of Sheet Metal, Air, Rail and Transportation Workers Local Union No.
28 (³Local 28´RUWKH³8QLRQ´FROOHFWLYHO\UHIHUUHGWRKHUHLQDVWKH³3DUWLHV´
WHEREAS the Collective Bargaining Agreement ³&%$´LQHIIHFWEHWZHHQWKH3DUWLHV
expires on October 31, 2025; and
WHEREAS the Parties met, discussed, and negotiated the terms of a successor CBA; and
WHEREAS the Parties have agreed on terms for the successor CBA; and
NOW, THEREFORE, the Parties agree as follows:
1. TERM OF THE AGREEMENT
The Parties agree on a three-year term for the successor CBA, which shall run from
November 1, 2025 to October 31, 2028.
2. WAGE INCREASES
The Parties agree to a total economic package increase of three dollars ($3.00) per year for
each year of the successor CBA, to be allocated as one dollar and fifty cents ($1.50) every
six months. The increase shall apply to the total economic package inclusive of wages and
benefits and shall become effective as of November 1, 2025.
3. MARKET RECOVERY ADDENDUM

or modifications except those expressly agreed to and contemplated by this Memorandum
of Understanding.

4. INTERMEDIATE JOURNEYPERSON
The Parties agree to implement a new IQWHUPHGLDWH-RXUQH\SHUVRQ³,-´FODVVLILFDWLRQIRU
work performed under the main agreement and Market Recovery Addendum. The IJ shall
be a temporary classification applicable to all graduating apprentices, commencing
immediately upon graduation from the apprentice program and concluding with
progression to full Journeyperson ³-3´ status once they have completed 1,000 hours
worked and 12 months time-in-title. No pre-apprentice or apprentice currently in the
program will become an IJ; the first class of IJs shall come from the first graduating class
that enters the pre-apprentice or apprentice program on or after November 1, 2025.
The IJ shall receive 85% of the full Journeyperson package.
IJs PD\ZRUN³DORQH´²i.e. not directly supervised by a full Journeyperson²but may only
perform tasks subject to the limitations that they cannot: (i) be a foreman; (ii) perform
siding or testing and balancing work; or (iii) work on a Trimble machine or on a laser
layout.
5. MARKET RECOVERY JOURNEYPERSON
7KH 3DUWLHV DJUHH WR LPSOHPHQW D QHZ 0DUNHW 5HFRYHU\ -RXUQH\SHUVRQ ³05-´
classification for work performed under the Market Recovery Addendum, which replaces
the existing classification of Journeypersons Working Light Commercial. The MRJ shall
be a full Journeyperson initially receiving a total package of $89.39 when voluntarily
opting to work in that classification, with an hourly wage equal to the full Journeyperson
wage but reduced benefit contributions. The MRJ shall receive the full increases that the
full Journeyperson package receives. A copy of the initial MRJ package and allocation is
attached hereto as Appendix A.
The MRJ may be included as part of the ratio on projects contemplated by the Market
Recovery Addendum, as provided in this Memorandum of Understanding. The Parties
agree to further discuss and implement the process for the hiring and referral of MRJs.
MRJs may only perform tasks subject to the limitations that they cannot: (i) be a foreman;
(ii) perform siding or testing and balancing work; or (iii) work on a Trimble machine or on
a laser layout.

The Parties agree to reallocate the existing Light Commercial Pre, Helper 1, Helper 2, and
Mechanic packages to move the vacation contribution into the hourly wage.
The Parties further agree to introduce a new Light Commercial Mechanic 2 classification
that receives a total package of $54.49 and new Light Commercial Mechanic 3
classification that receives a total package of $62.49, with the current Light Commercial

Mechanic classification being renamed as the Light Commercial Mechanic 1 classification.
A copy of the initial Light Commercial Worker package and allocation is attached hereto
as Appendix B.
The Pre shall advance to Helper 1 upon 500 hours worked and 6 months time-in title.
The Helper 1, Helper 2, Mechanic 1, and Mechanic 2 shall advance to their respective next
classifications upon 1,000 hours worked and 12 months time-in-title.
7. LIMITED DUTIES OF LIGHT COMMERCIAL WORKERS
The Parties agree that the limitations on the duties of LCWs on all jobs beyond the
parameters of the Market Recovery Addendum, which are located in Article III, Section 6
of the Addendum, shall be deleted and removed.
The limitations on the duties of LCWs generally, which are located in Article III, Section
3(f) of the Addendum, shall remain in full force and effect.
8. RENOVATION PROJECT RATIOS
The Parties agree to amend Article III, Section 3 of the Market Recovery Addendum to
provide for the following ratios to be utilized on renovation projects based on the total
value of the project:
x $100,000 to $400,000 ± 1:2 JP:LCW or 1:2:1 JP:LCW:MRJ.
x Above $400,000 ± 1:1 JP:LCW or 1:1:1 JP:LCW:MRJ, up to five times.
If there are no MRJs available, the Employer may use LCWs in their place.
9. RESIDENTIAL PROJECT RATIOS
The Parties agree to temporarily amend Article III, Section 3 of the Market Recovery
Addendum to provide for the following ratios to be utilized on residential projects based
on the location of the project:
x Manhattan ± 1:3 JP:LCW or 1:2:2 JP:LCW:MRJ
x Outer Boroughs ± 1:5 JP:LCW or 1:2:2 JP:LCW:MRJ
If there are no MRJs available, the Employer may use LCWs in their place. This pilot
program shall automatically expire on October 31, 2026 unless the parties mutually agree
to extend it.

10. RATIOS ON PROJECTS OUTSIDE THE MARKET RECOVERY ADDENDUM
The Parties agree to amend Article III, Section 6 of the Market Recovery Addendum to
provide for the following ratios to be utilized on all jobs outside the parameters of the
Market Recovery Addendum:
x 2:1 JP:MRJ then 2:1 JP:MRJ then 2:1:1 JP:MRJ:LCW, up to two times.
A maximum of 2 LCWs can be used on such projects. An LCW may not be used in place
of an MRJ.
11. EARLIER STARTING TIME
The Parties agree that, in the Renovation market only, the starting time shall be between
DPDQGDPDWHDFK(PSOR\HU¶VGLVFUHWLRQ(DFK(PSOR\HUPXVWSURYLGHQRWLFH
to the JLM prior to utilizing any start time prior to 6:30 a.m.
12. MONITORS AS JAB REMEDY
Amend Article XVII, Section 5 of the CBA to clarify that the Joint Adjustment Board
³-$%´KDVWKHSRZHUDQGDXWKRULW\WRDVVLJQDZRUNLQJPRQLWRUWRDQHPSOR\HUIRXQGWR
be in violation of the CBA, for the purpose of ensuring future compliance with the CBA.
This clarification would not abridge, diminish, or otherwise lessen the existing powers and
authority of the JAB to fashion and award appropriate remedies and relief.
13. APPRENTICE PACKAGE RESTRUCTURING
The Parties shall implement a new Apprentice wage and benefit progression, applicable
only to new pre-apprentices and apprentices indentured on or after November 1, 2025. Preapprentices and apprentices currently in the program shall maintain the existing wage and
benefit structure. A copy of the initial apprentice package and allocation is attached hereto
as Appendix C. The total hourly package shall be as follows:

on October 31, 2025 shall continue in the successor CBA and Market Recovery Addendum
unless expressly modified herein.
